Court grants interim relief
Cyril Ramaphosa approached the Western Cape High Court seeking to halt the impeachment proceedings while he challenges the legality of the Section 89 Independent Panel report.
The report concluded that the President had a case to answer over the theft of foreign currency from his Phala Phala game farm.
The court granted the interim order, preventing Parliament’s Impeachment Committee from continuing its public hearings until the review application has been determined.
Constitutional Court ruling led to impeachment process
The Impeachment Committee was established after the Constitutional Court ruled in May that the National Assembly had acted irrationally when it rejected the Section 89 panel’s recommendations.
The apex court ordered Parliament to institute impeachment proceedings in accordance with Section 89 of the Constitution.
Review hearing set for September
Cyril Ramaphosa’s application to review and set aside the Section 89 Independent Panel report is scheduled to be heard in September.
The outcome of that case is expected to determine whether Parliament’s impeachment process can proceed or whether the panel’s findings will be overturned.
The interim interdict means the impeachment proceedings will remain on hold until the court has ruled on the President’s review application.
