SC rejects gangster Abu Salem’s plea for early release in 1993 Mumbai blasts case

The Supreme Court on Thursday dismissed a petition filed by gangster Abu Salem seeking early release from prison in the 1993 Mumbai serial bomb blasts case, Bar and Bench reported.

Salem had contended that the remission he had earned for good conduct and undertrial custody should be counted toward the computation of his 25-year jail sentence, after completion of which he would be eligible for early release.
Remission is the reduction of the duration of a prison sentence without changing its nature, allowing for earlier release.
In September 2017, a special court under the Terrorist and Disruptive Activities Prevention Act in Mumbai sentenced Salem to life imprisonment for his role in the blasts that killed more than 250 persons.
He had been extradited from Portugal in November 2005.
Salem’s petition centred around the terms of the extradition treaty between India and Portugal under which he would have to be released on completion of 25 years in jail.
He had argued that the remission for good conduct and the undertrial custody amounts to more than three years, which needed to be set off against his full sentence. Based on this, Salem contended that he had completed his 25-year term by March 31, 2025.
The Maharashtra government maintained that Salem had not completed 25 years.
